POLICY FOR PUBLIC CONDUCT AND COMMENT AT BOARD MEETINGS

Conduct at Meeting Center. Meetings of the Board are open to the public. At all times while attending a meeting, the public shall observe common rules of courtesy and respect for the rights of District personnel, Directors, other residents, customers and other members of the public. Prohibited Conduct. The following conduct is prohibited (collectively, the “Prohibited Conduct”) when attending a District meeting: A. Use of profanity. B. Abusive and offensive behavior and/or language. C. Fighting. D. Harassing consultants, employees, personnel, customers, residents or other members of the public. E. Interfering with consultants, personnel and employees in the performance of their work. F. Interfering with the quiet use and enjoyment of the meeting location. G. Interfering with an employee’s job and/or his/her management of the meeting location. H. Any activity which constitutes a felony, a crime involving moral turpitude, assault, criminal mischief, or disorderly conduct. I. Public intoxication. J. Interfering with or disrupting the orderly conduct of any meeting. K. Refusing to refrain from talking (other than the period of public comment) during a meeting. L. Any unauthorized entry into any area of the meeting location other than the meeting room. M. Abusive conduct, personal charges or verbal attacks upon the character or motives of other members of the public, personnel, employees, or the members of the Board. Engaging in Prohibited Conduct. Anyone engaging in Prohibited Conduct for the first time will be asked to immediately exit and leave the meeting. If at any time the person engaging in Prohibited Conduct who has been asked to leave refuses to exit and leave the meeting, the District will summon a peace officer to escort and remove the person engaging in Prohibited Conduct from the meeting. The District will seek enforcement of disorderly conduct charges in instances where a person engaging in Prohibited Conduct engages in such prohibited conduct on three or more occasions. The failure on the part of the District to enforce any section, clause, sentence or provision of this conduct policy shall not constitute a waiver of the right of the District to later enforce any section, clause, sentence or provision of this conduct policy. Public Comment at Meetings of the Board. Members of the public are invited to attend District Board meetings. The Board has determined that in order to conduct the business appearing on the meeting agenda in a timely and expeditious manner, it is necessary to limit the amount of time to receive comments from members of the public. Public comments shall be limited to three (3) minutes per person and a total maximum period for all public comment of thirty (30) minutes. Once the period for public comment is concluded, the Board will resume with the business on the meeting agenda and the public shall refrain from commenting during this portion of the meeting. District Hearings. Public comments during hearings called and held by the District shall be limited to the topic of such hearing. Public comments concerning issues other than the topic of the public hearing shall be taken under the agenda item for such public comments. Procedure for Addressing the Board of Directors. Members of the public shall indicate on the sign-in sheet provided at the meetings whether they desire to address the Board. Thereafter, during the period of the meeting designated for receiving public comment, the presiding officer of the Board shall recognize those members of the public who indicated that they wished to address the Board. Members of the public are requested to keep their comments brief and to the point.

POLICY RELATING TO VIDEO/AUDIO RECORDING AT BOARD MEETINGS

Video/Audio Recording Board Meetings. Pursuant to Texas Government Code §551.023, the Board may adopt reasonable rules to maintain order at a meeting, including rules related to (1) the location of recording equipment; and (2) the manner in which the recording is conducted. The Board has determined that in order to conduct the business appearing on the agenda for a meeting in a timely and expeditious manner, and to maintain order at a meeting, it is necessary to adopt the following rules regarding recording devices: 1.Members of the public must notify the Board prior to the use of a recorder, video camera, and/or any other means of aural or visual recording. 2.The Board shall determine the location for placement of the recorder, video camera, and/or any other aural or visual recording device. 3.The recorder, video camera, and/or any other aural or visual recording device shall be placed in plain view in a location determined appropriate by the Board. 4.No secret or concealed recorder, video camera, and/or any other aural or visual recording device may be used or operated at any meeting of the Board. Section 9.02. Violation of the Rules of Recording. Any person who uses or operates a recorder, video camera, and/or any other means of aural or visual recording at any Board meeting without following the rules set out in Section 9.01, above, will be asked to immediately exit and leave the meeting. If at any time such person who has been asked to leave refuses to exit, the District will summon a peace officer to escort and remove the person from the meeting. BREACH OF THIS VIDEO/AUDIO POLICY FOR VIDEO/AUDIO RECORDING FOR THREE OR MORE TIMES MAY RESULT IN THE IMPOSITION OF A CIVIL PENALTY OF NOT LESS THAN ONE DOLLAR ($1.00) NOR MORE THAN FIVE HUNDRED DOLLARS ($500.00) FOR EACH VIOLATION. A penalty under this Section is in addition to any other penalty provided by the laws of the State of Texas and may be enforced by complaints filed in the appropriate court of jurisdiction in the county in which the District’s principal office or meeting place is located. If the District prevails in any suit to enforce this Video/Audio Policy, it may, in the same action, recover any reasonable fees for attorneys, expert witnesses, and other costs incurred by the District before the court. The failure, on the part of the District, to enforce any section, clause, sentence or provision of this Video/Audio Policy shall not constitute a waiver of the right of the District to later enforce any section, clause, sentence or provision of this Video/Audio Policy.

POLICY RELATING TO ONLINE MEETING RULES FOR THE PUBLIC AT BOARD MEETINGS

  • Please do not interrupt or speak unless addressed by the board or district consultants.
  • Only current agenda items will be addressed during the meeting.
